There are a number of exemptions and instruments kicking around regarding flight tests and who can do them.
As a rule of thumb, if you could conduct flight tests before 1st September for a pilot licence or rating (Night, Instrument, Instructor...) then you can conduct one now.
Some examples,
an instructor works in a remote location and obtains a delegation under CAR 5.23 to fix sticky strips to a logbook after conducting an aircraft endorsement.
The approvals under CAR 5.23 are not listed in the ATO / FTE transition instrument (243/14), so this instructor cannot conduct a Type Rating flight test today.
Issuing an aircraft endorsement before September is not the same as conducting a flight test for a Type rating today.
The same might be for an instructor who conducted low level training in the past and endorsed a logbook with that training, or a mustering pilot who was an approved person under CAR 5.20 / CAO 29.10, paragraph 12.
Unless that instructor held an approval under CAR 5.41 (4)
(4) CASA may set and conduct the following flight tests:
(a) commercial pilot (aeroplane) licence flight test;
(b) commercial pilot (airship) licence flight test;
(c) commercial pilot (balloon) licence flight test;
(d) commercial pilot (gyroplane) licence flight test;
(e) commercial pilot (helicopter) licence flight test;
(f) flight engineer flight test;
(g) general flying progress flight test;
(h) private pilot (aeroplane) licence flight test;
(i) private pilot (gyroplane) licence flight test;
(j) private pilot (helicopter) licence flight test;
(k) multi-crew pilot (aeroplane) licence flight test.
or an approval under CAR 5.19 (3)
(3) CASA may conduct the flight tests in relation to a flight crew rating, or grade of flight crew rating, that are required by the Civil Aviation Orders.
You can't conduct a flight test.
The devil is in the detail and I am worried that some people might have done the wrong thing due to misunderstandings.
